Invitation for Comments – Amendment of the National Information Technology Agency Act, 2008 (Act 771)
The new 2025 Bill features the transition of NITA from an Agency to an Authority. This is to improve institutional autonomy, enhance regulatory and enforcement capacity and expand the oversight powers of NITA.
Other key introductions in the NITA 2025 Bill include:
- Mandatory licensing for ICT service providers, sandbox framework for testing new technologies and coverage for future technologies: AI, blockchain, IoT, cloud infrastructure.
- Offences for unlicensed operations, false certifications, technical obstruction and clothes the Authority with Powers for suspension, revocation, administrative penalties and the closure of premises and asset seizures authorized for breaches and
- Establishment of the e-Government ICT operator, a duly incorporated company to be licensed by the Authority to manage, maintain and deploy government operations and infrastructure.
In view of this revision and in line legal and regulatory standards and principles,
NITA invites views and comments from:
- Ministries, Departments and Agencies (MDAs)
- Metropolitan, Municipal and District Assemblies (MMDAs)
- Private sector organizations and industry associations
- Academia and research institutions
- Civil society organizations and development partners
- And the general public
on the revised provisions and framework of the National Information Technology Authority Bill 2025.
The public consultation period will run from Friday, 17 October 2025 to Friday, 31st October 2025.

All responses and comments should be submitted as email attachments in Microsoft Word format to comments@nita.gov.gh.
Each submission must include a completed response cover sheet, which is available on Page 4 of the consultation document.
In the interest of transparency, all responses will be treated as non-confidential and may be published on the NITA website upon receipt. By submitting your response, you grant the Agency the right to use the copyright and any associated intellectual property contained in your submission to meet its legal and regulatory obligations.
Following the consultation, NITA will finalise the National Information Technology Authority Bill 2025 and forward same to the Minister responsible for Communication, Digital Technology and Innovations, who shall submit it to Cabinet and subsequently to Parliament in accordance with Section 29(4) of the Bill.
